INFRASCO INC. – LIMITED WARRANTY

1. Scope of Warranty. Infrasco Inc. warrants that each of its products is free from defects in materials and workmanship for a period of one (1) year from the date of shipment. This warranty is strictly conditional upon the product having been used for the specific purposes and under the specific technical conditions for which the product is intended according to the specifications and validation of the Buyer, and provided it has been used under normal conditions of use and service. The product must also have been installed and maintained in accordance with Infrasco Inc.’s instructions, industry standards such as AWWA or NFPA, and applicable local codes.

2. Obligations and Claim Procedure. Any claim under this warranty must be subject to prompt written notification to Infrasco Inc. by the Buyer. If it is proven that a product manufactured by Infrasco Inc. does not conform to the above warranty, the company may, at its sole discretion, refund, repair, or replace the defective product F.O.B. at the point of manufacture. Infrasco Inc. reserves the right to inspect the product that is the subject of a claim, and at the company’s request, the buyer must return the product at their own expense with freight prepaid. The buyer alone assumes all responsibilities and expenses for the removal, reinstallation, and shipping costs in connection with this warranty. 

3. Specific Exclusions and Compatibility. This warranty does not cover failures caused by external forces such as natural disasters, vandalism, vehicle impacts, freezing, or the application of excessive torque. Furthermore, this warranty expressly excludes any defect resulting from the incompatibility of the product with third-party equipment or original equipment manufacturer (OEM) fire hydrants, as well as any failure related to the lack of specific certification required by local authorities or insurers for a given installation. For products manufactured according to the Buyer’s specific plans or instructions, Infrasco Inc. warrants only conformity to the dimensions provided and disclaims all liability regarding the functional performance or safety of the final product.

4. Limitation of Liability and Waiver. This warranty replaces all other warranties, expressed or statutory, including warranties of fitness for a particular purpose and non-infringement of third-party rights. In no event shall Infrasco Inc. be liable for any direct, indirect, incidental, special, or consequential damages, which includes but is not limited to loss of profits, property damage, or third-party claims resulting from a fire or the inability of equipment to function during an emergency. Infrasco Inc. hereby limits its total liability to the net value of the product sold. 

5. Time Limitation. Any claim by the Buyer regarding goods sold hereunder for any cause whatsoever shall be deemed waived by the Buyer unless it is submitted in writing to Infrasco Inc. within thirty (30) days following the date on which the Buyer discovered, or should have discovered, the alleged breach.
